The scenario you described is exactly what the CBA prevents. To do this, free agents continue to count against a team?s cap until they are re-signed, sign somewhere else, or are renounced. In Kobe?s case, he will continue to count $32 million against the Lakers? cap, so if they otherwise would have $50 million in cap room, with Kobe as an unsigned free agent they?d only have about $18 million.

Renouncing happens when a team wants to regain the cap room that is tied up by their free agent. When a team renounces a player, it gives up the right to re-sign the player using Bird rights. So if the Lakers renounce Kobe they will regain that $32 million in cap room. But then they will only be able to re-sign him with cap room or the Room Mid-Level exception.
