What is real estate legal malpractice?

by admin on September 27, 2012

Real estate legal malpractice occurs when an attorney who is handling a real estate? transaction commits legal malpractice, which results in harm to the client. According to the American Bar Association, who has surveyed legal malpractice claims since 1985, for the first time in the history of the survey, real estate malpractice claims are the most common types of legal malpractice claims.

It?s estimated that real estate malpractice claims account for about 20 percent of all claims. Some experts say that?s not a surprise, and that there?s also been an increase in litigation throughout the entire legal industry. Claims against real estate brokers, title companies and real estate agents are also increasing. Some blame the increase on the downturn into the housing market overall, finding that when more attorneys were involved in foreclosures, naturally homeowners were angry and more mistakes were made.

Some experts believe that real estate legal malpractice claims are on the decline again, because foreclosures are slowing down and several entities have combined to slow down the foreclosure process. Court cases involving foreclosures are slowing down, and mortgage help programs and mediation programs are increasingly available, so it?s likely that real estate legal malpractice claims will continue to slow.

Do you feel that your real estate attorney committed legal malpractice? If so, you may have a cause of action against the attorney. Call a Houston legal malpractice attorney today.

'I'm bored!' -- Research on attention sheds light on the unengaged mind

ScienceDaily (Sep. 26, 2012) ? You're waiting in the reception area of your doctor's office. The magazines are uninteresting. The pictures on the wall are dull. The second hand on the wall clock moves so excruciatingly slowly that you're sure it must be broken. You feel depleted and irritated about being stuck in this seemingly endless moment. You want to be engaged by something -- anything -- when a thought, so familiar from childhood, comes to mind: "I'm bored!"

Although boredom is often seen as a trivial and temporary discomfort that can be alleviated by a simple change in circumstances, it can also be a chronic and pervasive stressor that can have significant consequences for health and well-being.

Boredom at work may cause serious accidents when safety depends on continuous vigilance, as in medical monitoring or long-haul truck driving. On a behavioral level, boredom has been linked with problems with impulse control, leading to overeating and binge eating, drug and alcohol abuse, and problem gambling. Boredom has even been associated with mortality, lending grim weight to the popular phrase "bored to death."

Although it's clear that boredom can be a serious problem, the scientific study of boredom remains an obscure niche of research, and boredom itself is still poorly understood. Even though it's a common experience, boredom hasn't been clearly defined within the scientific community.

Psychological scientist John Eastwood of York University (Ontario, Canada) and colleagues at the University of Guelph and the University of Waterloo wanted to understand the mental processes that underlie our feelings of boredom in order to create a precise definition of boredom that can be applied across a variety of theoretical frameworks. Their new article, which brings together existing research on attention and boredom, is published in the September 2012 issue of Perspectives on Psychological Science, a journal of the Association for Psychological Science.

Drawing from research across many areas of psychological science and neuroscience, Eastwood and colleagues define boredom as "an aversive state of wanting, but being unable, to engage in satisfying activity," which arises from failures in one of the brain's attention networks.

Specifically, we're bored when:

 • We have difficulty paying attention to the internal information (e.g., thoughts or feelings) or external information (e.g., environmental stimuli) required for participating in satisfying activity
 • We're aware of the fact that we're having difficulty paying attention
 • We believe that the environment is responsible for our aversive state (e.g., "this task is boring," "there is nothing to do").

The researchers are confident that integrating the disparate fields of cognitive neuroscience, social psychology, and clinical psychology will produce a more thorough understanding of boredom and attention -- phenomena which are ubiquitous and intimately linked.

Armed with a precise and broadly applicable definition of boredom that gets at the underlying mental processes, the authors identify important next steps in research on boredom. Eastwood and his colleagues hope to help in the discovery and development of new strategies that ease the problems of boredom sufferers and address the potential dangers of cognitive errors that are often associated with boredom.

Summer's over, drought persists in most of Lower 48

By Miguel Llanos, NBC News

You'd think the end of summer would mean the end ? or at least beginning of the end???of this year's drought, but the nation's official stat keepers on Thursday revealed otherwise.

With the Midwest corn harvest in full swing, the worst U.S. drought in decades actually worsened:?65.45 percent of the lower 48 states was in some form of drought on Tuesday, up from 64.82 percent a week earlier, according to the U.S. Drought Monitor.?

The 65.45 percent is a new record in the 12-year index tracked by the monitor, and it could get worse before getting better.

"I would not be too surprised to see conditions continue to worsen if we do not see widespread rain/snow events" soon, Brian Fuchs, a climatologist who compiles the stats for the Drought Monitor, told NBC News. "The forecast does not bode well for any type of widespread improvements any time soon outside of the central and eastern Corn Belt and maybe into portions of Arkansas and Texas."

"The western and northern Great Plains have indeed continued to worsen and this has spread into the central and northern Rocky Mountains as well," he added.

Brad Rippey, a meteorologist for the Department of Agriculture, noted that?the Seasonal Drought Outlook indicates any improvements are likely to "be at least partially offset by worsening conditions from the Pacific Northwest to the upper Midwest."?

Why the drought's impact on a small sector of the economy could sway the presidential election, with CNBC's Steve Liesman.

Other stats from the latest Drought Monitor were not encouraging:

 • Areas in extreme or exceptional drought, the two worst categories, were at 21.5 percent, up from 20.7 percent a week earlier.
 • The worst drought conditions remain in the heart of the U.S. breadbasket, weather.com reported: Nebraska at 73 percent, Kansas at 51 percent and Oklahoma at 42 percent.
 • Iowa: 100 percent of the nation's biggest corn producer is in some form of drought. That's the same as the previous week.
 • Minnesota: 77 percent is now in drought, up from 64 percent, with extreme conditions in the northwest and spreading into southern areas, weather.com noted.
 • North Dakota: 95 percent is in drought, up from 88 percent the week before.
 • South Dakota: The entire state is in some form of drought, up from 96 percent.

As bad as it's been, some farmers are feeling lucky they got as much out of their harvests as they have.

"Technology and farm practices have helped compared to the last significant drought in the Corn Belt back in 1988," said Fuchs.

That technology includes seed hybrids engineered to be drought tolerant. While environmentalists are concerned genetically engineered plants will alter ecosystems, farmers are quick adopters.

Another factor has been Mother Nature.

"Some soybeans in the mid-South and lower Midwest were helped by late-summer rainfall, which included the remnants of Hurricane Isaac," said Rippey.

In the case of corn, "perhaps one of the biggest wild cards ... was the timing of reproduction," he added. A June/July heat wave "hammered corn in the lower Midwest," he said, while the western Corn Belt was hit by a separate heat wave in July.?

"Fields that managed to pollinate either before or after these two heat waves fared better," he said.

"Still, we lost more than one-quarter (28 percent) of the U.S. corn production from pre-drought estimates ? a total of nearly 4.1 billion bushels," he said. "Nearly one-fifth (18 percent) of the U.S. soybean production, or 575 million bushels, was lost."

Russia reveals shiny state secret: It's awash in diamonds

'Trillions of carats' lie below a 35-million-year-old, 62-mile-diameter asteroid crater in eastern Siberia known as Popigai Astroblem. The Russians have known about the site since the 1970s.

Russia has just declassified news that will shake world gem markets to their core: the discovery of a vast new diamond field containing "trillions of carats," enough to supply global markets for another 3,000 years.

The Soviets discovered the bonanza back in the 1970s beneath a 35-million-year-old, 62-mile diameter asteroid crater in eastern Siberia known as Popigai Astroblem.

They decided to keep it secret, and not to exploit it, apparently because the USSR's huge diamond operations at Mirny, in Yakutia, were already producing immense profits in what was then a tightly controlled world market.

The Soviets were also producing a range of artificial diamonds for industry, into which they had invested heavily.

The veil of secrecy was finally lifted over the weekend, and Moscow permitted scientists from the nearby Novosibirsk Institute of Geology and Mineralogy to talk about it with Russian journalists.

According to the official news agency, ITAR-Tass, the diamonds at Popigai are "twice as hard" as the usual gemstones, making them ideal for industrial and scientific uses.

The institute's director, Nikolai Pokhilenko, told the agency that news of what's in the new field could be enough to "overturn" global diamond markets.

"The resources of superhard diamonds contained in rocks of the Popigai crypto-explosion structure are, by a factor of 10, bigger than the world's all known reserves," Mr. Pokhilenko said. "We are speaking about trillions of carats. By comparison, present-day known reserves in Yakutia are estimated at 1 billion carats."

The type of stones at Popigai are known as "impact diamonds," which theoretically result when something like a meteor plows into a graphite deposit at high velocity. The Russians say most such diamonds found in the past have? been "space diamonds" of extraterrestrial origin found in meteor craters. [Editor's note: The original version misstated the type of deposit needed to create impact diamonds.]

They claim the Popigai site is unique in the world, thus making Russia the monopoly proprietor of a resource that's likely to become increasingly important in high-precision scientific and industrial processes.

"The value of impact diamonds is added by their unusual abrasive features and large grain size," Pokhilenko told Tass. "This expands significantly the scope of their industrial use and makes them more valuable for industrial purposes."

Russian scientists say the news is likely to change the shape of global diamond markets, although the main customers for the super-hard gems will probably be big corporations and scientific institutes.

Chicago Symphony musicians settle strike | OregonLive.com

And just like that, the Chicago Symphony musicians settled their strike. From the Chicago Tribune:
"They entered the negotiating room in the Chicago Symphony Association's lawyer's office at 2 p.m. Monday, and by about 6:45 p.m. a tentative agreement had been reached in the Chicago Symphony Orchestra's first musicians strike in 21 years.

"The orchestra announced shortly before 8 p.m. that the CSO musicians and management had reached an accord for a three-year collective bargaining agreement, to take effect retroactively on Sept. 17. The previous contract expired Sept. 16.

"...The strike became the latest in a series of labor disputes among big-city American orchestras. The tumultuous six-month Detroit Symphony Orchestra strike ended in April 2011 with the musicians accepting a reported 25 percent pay cut. The Philadelphia Orchestra, where Muti was music director from 1980 to 1992, emerged from bankruptcy protection in July and still faces formidable challenges.

"Members of the Atlanta Symphony Orchestra have been locked out since Aug. 25, and Indianapolis Symphony Orchestra musicians have been locked out since Sept. 8 amid management proposals of large salary and benefits cuts. The Minneapolis-St. Paul-based Star Tribune reported that the Minnesota Orchestra's musicians and management were meeting with a federal mediator Monday, six days before the union's contract was set to expire, with management initially proposing to slash musicians' average salaries from $135,000 to $89,000."

Mrs in Training: Outdoor Movie Birthday Party

In my family, I have a godbrother and a godsister. ?My godparents, the couple that sponsored me when I was baptized, had two children. ?They lived across the street, and they've always been better than most family, so as kids we had to give each other titles also.

Robbie is my godbrother, and he turns 30 this week. ?His wife, Rose, planned the neatest outdoor movie party. ?Her parents have a gorgeous house on the Eastern Shore of Maryland, and they had a large screen and projector, lawn chairs set up, and the best buffet of movie-worthy snacks.?

I had the pleasure of making the cake! ?I modeled it almost identically on inspiration that Rose sent me.

This was actually my second round of attempts at the cake, since my first cakes fell, and I ended up being an hour late at the party, oops. ?We did carrot cake at birthday boy's request, but I left out the nuts. ?Unfortunately, the powdered sugar star didn't hold up well with the moist icing, and those were the fourth attempts Tyler and I made at sugar cookie hand prints, but it turned out pretty well!

And some other shots from the set up that Rose put together:

Guinevere had a fantastic time running around outside in the dark, stealing glow light necklaces from everyone and making new friends. ?She eventually passed out WAY past her bedtime, and around midnight mom and I hit the road as well. ?It was a super fun night though, and I loved getting to see our family.

On a side note, I definitely do NOT recommend the drive home from there at night. ?We had to cross the Bay Bridge, and it was absolutely terrifying, the most white knuckle experience I have ever had. ?I'm grilling mom "If someone hit us, would we go through those side rails?" and "Exactly how high up are we?" ?I was frantically trying to remember every action movie I had ever seen, and mapping out a plan for getting Guinevere out of her carseat and up to safety, down to remembering I should blow on her face before opening the window so she held her breath.

Needless to say...we survived.

Homemade Pregnancy Examination ? How Exact Are Family Home ...

?

Missing a period is usually the trigger, but other factors like vomiting and nausea, food cravings and lower abdominal pains can also contribute to this anxiety. A pregnancy test looks for markers that are associated with pregnancy, in this case the hormone human chorionic gonadotropin (hCG). This hormone, while it can accurately indicate pregnancy, cannot be detected before implantation.

Testing for pregnancy too early can produce negative readings even if the woman is, in fact, pregnant. This characteristic of hCG has led to many an anxious lady asking, How soon can I take a pregnancy test? Implantation normally takes place 7 to 10 days after ovulation. Some tests say that it is possible to test for pregnancy on the day the menstrual cycle is due.

Others even suggest that it is possible to take a pregnancy test 14 days before possible conception. Read the rest of this entry First month of pregnancy So you are pregnant?

Congratulations! In this video you can learn what is happening in your body right now. Here are some tips I collected from the internet on how to increase your chances of getting pregnant the next time- Tip # 1.

This week in EM, expect more doves | Global Investing

With the U.S. Fed having cranked up its printing presses, there seems little to stop emerging central banks from extending their own rate cut campaigns this week.

The most interesting meeting promises to be in the Czech Republic. We saw some extraordinary verbal intervention last week from Governor Miroslav Singer, implying not only a rate cut but also recourse to ?unconventional? monetary loosening tools. Of the 21 analysts polled by Reuters, 18 are expecting a rate cut on Thursday to a record low 0.25 percent.? Indeed, in a world of currency wars, a rate cut could be just what the recession-mired Czech economy needs. But Singer?s deputy, Moimir Hampl,? has muddled the waters by refuting the need for any unusual policies or even rate cuts.? Expect a heated debate (forward markets are siding with Singer and pricing a rate cut).

Hungary is a closer call, with 16 out of 21 analysts in a Reuters poll predicting an on-hold decision. The central bank board (MPC) is split too. Analysts at investment bank SEB point out that last month?s somewhat surprising rate cut was down to the four central bank board members appointed by the government. These four outvoted Governor Andras Simor and his two deputies who had favoured holding rates steady, given rising inflation. (Inflation is running at 6 percent, double the target).? That could happen again, given the government just last week reiterated the need for ?lower interest rates and ample credit.? So SEB analysts write:

The 4-3 majority of the MPC has shown their appetite for cuts which according to the minutes could continue as long as ?the perception of the economy continue to improve?. The current 282 level of the euro/forint would not in our view stand in the way of another cut.

Elsewhere in the region, Israel and Romania are expected to make no change to interest rates, with both banks swayed by recent spikes in inflation.

In Latin America, investors? eyes will be on Colombia which has delivered back-to-back interest rate cuts and may provide another on Friday.? Sure,? Colombia?s economy was? robust in the second quarter but since then economic data has been hinting at some weakness ahead. Inflation is well-behaved.? Most importantly, Bogota cannot afford to let its peso appreciate even as its neighbours and trade partners weaken their currencies.? The central bank has already been intervening to buy dollars ? a rate cut would take some of the pressure off, say Goldman Sachs analysts:

The authorities, particularly the Treasury, remain every concerned with the exchange rate dynamics and the peso?s overvaluation. Hence, another 25bp rate cut also helps the authorities? to contain/mitigate the pressure on the COP to appreciate.

The 1917 Fiat Botafogo Special—And its WWI Aircraft Engine

For me, there's nothing quite like driving a really big, torquey vintage engine. Put an old aircraft engine in a car and it's even better.

Early-20th-century plane engines were simply bigger and better-constructed versions of automotive powerplants. All the moving parts were machined to aircraft standards, which were much higher than a car's for obvious reasons. They had redundant features, such as two ignition systems, in case one didn't work.

After World War I, a small group of speed enthusiasts started putting surplus warplane engines in big and sturdy car frames. It was a tremendous feat of engineering. With that giant engine in the car, you were basically flying on the ground. Racing aircraft-engine cars became especially popular at the Brooklands circuit in England. It was one of the first banked oval tracks and perfect for powerful cars with little to no braking. Count Louis Zborowski's four Chitty Bang Bang specials were the most famous examples. The origin of the odd name is disputed, but the cars became renowned, inspiring the similarly named children's book and later the movie.

I have four cars with aircraft engines. Three of the engines are from World War I, and one is from World War II. My newest car is a 1917 Fiat called the Botafogo Special. It was built by an Argentine racer named Adolfo Scandroglio. He was an admirer of Sir Ernest Eldridge, who owned the legendary, record-setting Fiat Mephistopheles racer that went 146 mph in 1924 on a public road in France. Scandroglio built this car as a copy and named it after the racehorse Botafogo, Argentina's Secretariat.

The Botafogo Special's World War I 21.7-liter Fiat A.12 engine was used in more than a dozen kinds of Italian airplanes. It has six huge cylinders with four valves each, overhead cams, twin magnetos, and a dry sump?pretty modern, considering it was designed in 1912. Each piston's displacement is bigger than that of a 3-liter engine. It barely makes 320 hp at 1800 rpm, but all that torque just wafts you along. At 60 mph you're using only 800 rpm. The heat the engine puts out is incredible.

The Botafogo originally didn't have brakes or a transmission. I have no idea how the car stopped, but that didn't prevent Scandroglio from racing it. An old photo I have shows a big vertical hook on the front. When the car went off the road, the hook was supposed to prevent injury by catching any of the barbed-wire fencing common throughout the Argentine countryside. Sadly, Scandroglio was killed while racing this car in 1949. Then the Botafogo disappeared. Luckily, the engine was found in the 1990s by the guys at Pur Sang, an Argentine company that builds exact replicas of Bugatti Type 35s and Alfa Romeo 8C 2300s. They reconstructed the car and added an old Mercedes-Benz four-speed transmission and two rear-wheel drum brakes. I bought it from them last year.

The Botafogo can probably go 146 mph, so it also has a modern horn now. With only two brakes, the car doesn't stop fast, and you want to warn people to get out of the way.

Before heading out, some predriving maintenance is necessary. It's part of the romance of these old aircraft engines. With its exposed valve gear, you don't want to start up anything dry, so you give the valves and rockers a few squirts of oil. Then you pump up the fuel pressure by hand using a big lever in the cockpit. Next you pump, or "tickle," the carbs to open the floats and let in more gas. Finally, off you go.

On the road, it's as if you're actually taxiing in a World War I airplane. It's great fun. You feel like you ought to be strafing other cars as you go down the highway. Redline is 1800 rpm, so the engine pulls 300 or 400 rpm with incredible stump-pulling torque?tic-tic-TIK-TIK-TIKA-TIKA-VROOOMMMM!

A huge chain drives each rear wheel, so you have to remember not to drop your hand over the side of the cockpit. I love the raw mechanicalness of old chain-drive cars. It's like you're Marley's ghost, with those exposed chains clattering. People stand on the street and just stare. When you drive a noisy, smoking monster car, you quickly realize how far we've come with modern vehicles.

The Botafogo isn't the best car for L.A.; low speeds on the city's typically congested streets result in a carbon buildup in the combustion chambers that causes the plugs to "load up," or fire intermittently. But get it out on the open road, put your foot down, and it's fantastic. There's no modern equivalent, not even a Hemi.

Saturday Morning Wisconsin Sports Report

Posted Saturday, September 22, 2012 --- 5:30 a.m.

Here is the latest Wisconsin sports news from The Associated Press

WASHINGTON (AP) ? The Milwaukee Brewers are surging at the right time in their effort to capture the second National League wild card spot. They beat the Washington Nationals, a team almost certain to be in the postseason, 4-2 last night. Ryan Braun and Aramis Ramirez had consecutive RBI hits in the ninth. The Brewers are 1 1-2 game behind the Cardinals.

ST. PETERSBURG, Fla. (AP) ? The Milwaukee Brewers have added a new catcher to their roster. They acquired Yorvit Torrealba yesterday from the Toronto Blue Jays for a player to be named later. Torrealba has played just 10 games for the Blue Jays this year, hitting .214 with one home run and two RBIs.

RENTON, Wash. (AP) ? So far the Seattle Seahawks haven't shown much indication that their passing attack can keep up with Aaron Rodgers and the Green Bay Packers. Russell Wilson was dynamic during the preseason for Seattle, but through two weeks it is last in the NFL in passing yards. The teams face off Monday night in Seattle.

SOUTH BEND, Ind. (AP) ? Notre Dame coach Brian Kelly is under no illusions that the Irish are going to shut down Michigan quarterback Denard Robinson. Containing him, however, will be essential in the battle of two of college football's most storied programs. The Irish are ranked 11th and haven't cracked the top 10 since 2006. Michigan is 18th.

Additional oil response capability needed in Alaska

Much attention has been focused on the Department of Interior's decision to allow Shell to begin drilling off of the Alaskan coast. Surprisingly, little attention has been paid to the Coast Guard's ability to respond to any oil spills that might occur as a result of this additional drilling. The Coast Guard is the lead agency for Federal oil spill response and it does not currently have enough assets in place to respond in a timely manner to a significant oil spill in Alaskan waters.

When building new subdivisions, land developers construct new fire houses. Similar thinking was not applied to the development of the Chukchi Sea. In 2008, the Federal government auctioned off leases to drill in the area. Shell, Statoil, ConoccoPhillips, and others bid over 2.6 billion dollars for the opportunity to drill. None of this money went to building additional Coast Guard vessels that could be used to respond to an oil spill.

Today, the Coast Guard only has twelve large ships stationed in Alaska; to cover over 33,00 miles of coastline. Two of the twelve, a flight-deck equipped cutter and a 225-foot buoy tender with some ice capabilities have been dedicated to the Shell operation. There is no clear indication whether the remaining ten will be similarly dedicated to the future Statoil and ConoccoPhillips operations. If they are, the Coast Guard's ability to fulfill its remaining missions including aids to navigation; fisheries and customs enforcement; and search and rescue will be severely hampered.

The Coast Guard should not attempt to close the asset gap by moving ships and helicopters from the lower 48 states to Alaska during the summer drilling months. Similarly, the Coast Guard should not plan on surging assets from the lower 48 states if an oil spill were to occur in Alaska. The summer months are prime hurricane months and the Coast Guard had to surge helicopters from Alaska to assist with Hurricane Katrina.

Instead of moving around its limited assets, the Coast Guard should work with the Department of Interior to use the funds gained from the drilling leases to finance additional Coast Guard ships and helicopters. Shell is merely the first company to begin drilling. ConoccoPhilips wants to begin drilling in 2014 and others soon after. Given the long construction time for these additional assets, the collaboration between the two federal entities should occur immediately.

Lastly, the Department of Interior should clearly assess the state of the Coast Guard assets in Alaska before approving ConoccoPhillips permit application. If two of the current twelve ships are dedicated to the Shell drilling operation then there are two less to dedicate to ConoccoPhillips and the remainder of the Coast Guard mission requirements. These missions requirements are equally as important as responding to oil spills and are equally as important in bringing in jobs and money to the state of Alaska.

Home / News for Home Owners / Bring New Life to Your Renovation with Old Pieces

Now that your home renovations have been completed with a new contemporary look, you may find yourself realizing that filling the empty room can be exciting, but challenging. One direction you could take your interior design is a creative one, where you bring in old pieces to combine with the new appearance. This will create a warm, inviting atmosphere.

Renovation Design

Mixing old antiques with a new renovation is a great way to add interest and history to a home.

Old pieces of furniture often have decades of family history and even a story to go with them. ?They can reflect your personal style. The sheen of a newly painted wall or carefully designed stylish tile floor in your home renovations can be softened by the warm colorful look of antiques. Flea markets, yard sales or the local antique stores are great places to add pieces to your venue. Architectural salvage warehouses may also provide opportunity for interestingly older styled doors, shelving material, and other architectural items.

One caution to keep in mind however, is to not blanket the room with antiques. This will give a cluttered look. A few, well-placed pieces can add a soft touch that enhances the overall ambiance. For an even more creative approach, consider a mixture of old and new furniture and wall decorations that blend tactfully to suit your personal preferences.

Essentially, using old furniture and decorative pieces together can provide the final touches to complete your home renovations. For professional advice and much more information about home renovations, simply visit the NARI Atlanta website. If you don?t have plans for next weekend, you may also be interested in checking out the NARI Tour of Remodeled Homes ? where you?ll see this kind of inspiration first hand!

Gaming Nexus - Do you want to play MechWarrior Online? Let's us ...

Are you excited for the upcoming MechWarrior Online? You should be because the game is looking incredible. Unfortunately, the game still doesn?t have an official release date and most fans are simply waiting for a chance to get their hands on the game. Well, it just so happens that we might be able to help you with that.

I have in my possession 10 codes that will give you exclusive, immediate access to the current beta of the game being run by Piranha Games. That is right, ten of our readers will be playing the game this weekend and until further notice from Piranha Games (until the beta closes down). Mind you, participating in the beta program will require you to agree to some terms and conditions, as this isn?t a full public beta (and even those have some).

Getting a hold of one of these codes is going to be pretty simple. Five codes will be randomly distributed through our Twitter account in the next hour (http://twitter.com/GamingNexus); I will put up the codes with two missing characters along with a clue as to what is missing). The other five well, those will go out the same way, just right here.

I am going to utilize a theme in these ?hints?, as they all have to do with the history of video games. Namely, specific years. For example, I may give the clue ?Sony released the PlayStation Vita in the U.S. in this year (20xx)? and it will correspond to a code such as the following: ABCD-1234-QPxx. Since the Vita launched earlier this year in the U.S., you would fill in the the xx of the code with 12 and redeem the code as ABCD-1234-QP12. Make sense?

All of these are being offered on a first-come, first-serve basis, so you had better move fast. Please be considerate and post a comment or a reply to the Tweet if you successfully redeem a code... and have fun! Also, have a peak at the most recent trailer for the game which will give you a little insight on what is in store in the beta program:

?

 • Code #1- A new trend was born in this year when Game Zero ceased phycical publication of their magazine and took their content online (19xx): 4BE51AC7-09ED-4056-xx3E-5B2E31FD4ECE

?

 • Code #2- Nintendo released the first issue of Nintendo Power in 19xx: 85BE6EC2-030E-4C7F-xxA1-C07157682809

?

 • Code #3- Namco broke into the arcade scene in this year (19xx) with their title Gee Bee: xx20DDA9-0C3F-451E-8E0D-9CF4BE616B7A

?

 • Code #4- Adventure, recognized as the first visual adventure game and the first game to include ?Easter Eggs?, launched for the Atari 2600 in this year (19xx): CE9FA8C0-6xxB-4757-A7DF-85AFFB5E60AF
 • Code #5- This is the year that Bonk made his first appearance in the U.S. (19xx): 79D128FC-46xx-450A-969F-7F4B67EBE2D6

Advice On Selecting The Right House Windows For House | Your ...

No matter what you wish to purchase or you need to repair your wood frame storm windows, here are the good advice and tips you will need to check out.

Wood storm windows can be very attractive in many different ways. For one, wooden windows look very natural and pleasing to the appearance of the house. Coating the window with the right choice of shade will surely add to the beauty and it will be easier to maintain. Wood storm windows are also best inside the house due to the fact that it will not be affected by the extreme weather condition that happens outside of the house.

Wood storm windows have long been a traditional solution to air leakage problems, as well as a cost-effective alternative to window replacement. Even though the window replacement industry now offers various other materials to choose from that are just as inexpensive and can do the job as well, there is still a considerable demand for wood storm windows as they can be customized to fit any type of home decor and when well-maintained can also guarantee years and years of service and use.

Installing wood storm windows onto the interior of the present framework could solve a number of problems simultaneously. They can reduce drafts as well as make the living space feel a lot more comfortable in windy and cold weather conditions, while simultaneously providing a buffer against noise. They can accomplish this while continuing to fit in with the aesthetic design of your property, in such a manner as to be undetectable from the outside. The home can maintain its character while becoming much more ideal as a dwelling for today?s modern lifestyle. Glass, which happens to be highly insulating and also Energy Star compliant, may also be used together with wood storm windows.

The advantage of using wood storm windows fitted on the inside can be further enhanced by fitting energy efficient glass. You will have the decorative element of wood, the insulating property of a storm window. The energy efficiency of the glass has the great advantage of keeping your energy bill low. What storm windows do is that they reduce and even stop drafts in a room to make it warmer and cosier in cold weather. The barrier created is not only against noise but it can also serve as a security barrier.

The low environmental impact of wood storm windows is one of their abiding attractions, but of course this can be severely reduced when the wood is coated with artificial materials. A stain or coat which is absorbed in to the wood at least allows it to keep its natural appearance, unlike the plastic covering of a composite window frame which will simply make the window look plastic and artificial. The need to coat a window frame in this way is virtually eliminated if you are fitting your storm windows on the inside of the existing window frame, but outdoors it can save a lot on maintenance work.

sales teleselling: Using Telemarketing Services to Generate New ...

AppId is over the quota
AppId is over the quota

The production and diversification of business operations correspond to a chief concern for almost all firms and enterprises. It is only natural that a lot of effort should be taken into consideration, and also time and money. Since setting up an in-house sales lead telemarketing team has proved to be quite costly, the rise of b2b (business to business) telemarketing to generate sales leads has become quite popular in the past years. Under this system, the favored and more cost-effective option for all companies and business enterprises is to outsource their telemarketing tasks. The end result would be more firms are capitalizing on all the benefits which can be obtained from partnering with a reputable telemarketing company.

Sales lead generation is among the most significant services which a telemarketing service provider can give. Other b2b telemarketing programs also involve telesales, email support, customer service and appointment setting. They can also be very advantageous to your organization. As a matter of fact, b2b telemarketing services represent the strongest and most cost-efficient strategy intended for direct sales. As already mentioned before, establishing a sales lead marketing team inside the company can be expensive and not time-effective. However, making use of phone marketing programs provided by a specific agency would improve your marketing campaign and expand your market reach, while at the same time, being very time and cost-effective. Not to mention that this useful and helpful tool enables business owners to supply the answers to all of their client's queries, while also rising above any likely unfavorable initial impressions as well as how to address the clients' concerns. Eventually, the telemarketing leads produce a continuous stream of possibilities for the development of business enterprises that make use of them, and of course, for the continued long-term success.

The most qualified sales lead generation could only be provided by the most professional and experienced sales lead telemarketing specialists. Intensive filtering of the target market of each firm and looking beyond the market trends of every particular niche is what makes sales lead generation qualified and makes sure that most leads would be closed out. But then again, sales lead generation is simply not just about giving a firm with a myriad of leads. It must be about sorting through these leads to the level of every company's precise needs and standards.

A professional sales lead generation would considerably add to the bottom line of your enterprise, but it takes a quality business to business telemarketing programs to guarantee that. Also, this process aids the sales staff within the organization very much, in that all the likely clients they approach will already be pre-qualified, which also means that the opportunities for the sales appointment converting into a real sale are higher.

With the advantages of telemarketing programs being covered, there is another facet to consider, and that is making the right choice in hiring a telemarketing firm. Moreover, the needs of the client should be the primary focus of the agents' continuous training. This is the kind of b2b telemarketing agency that business owners must be looking for, the kind that aims to ensure that every sales lead is just as good as a definite sale.

Belinda Summers is a professional telemarketer and appointment setter with extensive experience in generating qualified b2b sales leads for businesses through telemarketing. Learn more by visiting http://www.callboxinc.com/

The High Cost of Out-of-Pocket Expenses - NYTimes.com

It comes as a shock: how much people have to spend on medical care for a frail older relative in the last several years of life.

A common assumption is that Medicare will pay for almost everything. But that?s mistaken.

As a new study by researchers at the Mount Sinai School of Medicine in Manhattan documents, out-of-pocket costs for older adults at the close of life often place a significant financial burden on individuals and families.

The report, published in The Journal of General Internal Medicine, analyzed data about 3,209 people who participated in the national Health and Retirement Study and who died between 2002 and 2008. The survey, sponsored by the National Institute on Aging, collects information about medical out-of-pocket spending every two years.

Key findings are eye-opening:

 • On average, people with Medicare coverage paid $38,688 for medical care in the last five years of life.
 • There was enormous variation, with 25 percent of participants spending an average $101,791 out-of-pocket for medical services and 25 percent spending an average $5,163 during this period.
 • One-quarter of older adults incurred out-of-pocket medical expenses that exceeded the total value of their assets during this five-year period. Forty-three percent of older adults incurred expenses that exceeded their assets, excluding the value of their homes.
 • People with Alzheimer?s disease spent more than those with any other type of illness ? an average $66,155 during the last five years of life, compared with average spending of $32,129 for cancer, $37,996 for cardiovascular disease and $38,517 for diabetes.
 • Long-term care expenses (nursing home, assisted living), which aren?t covered by Medicare, much to many families? deep surprise, were the No. 1 category of out-of-pocket spending, followed by home health care.

What?s behind these costs? Although it is a fairly comprehensive program, Medicare doesn?t cover everything. Besides long-term care, traditional Medicare also does not pay for companions or homemakers who help older people get dressed, eat, bathe and cook; dental services; hearing aids and eyeglasses.

Not surprisingly, as people become more frail and need more help, their out-of-pocket expenses soar ? so long as there are resources available to pay for these services.

Other categories of expense for people who have Medicare include premiums for Part B (which pays for doctors? care and outpatient services), averaging just under $100 a month this year; premiums for Part D drug coverage, averaging about $30 a month; and premiums for supplemental coverage (which cover some but not all expenses not covered by Medicare), averaging about $177 a month.

For those who can?t afford supplemental coverage or who don?t have retiree insurance coverage, expenses can be quite substantial. Under Medicare, there?s an initial deductible for hospital care of $1,156, with an expected payment of $289 a day after a hospital stay exceeds 60 days (until the 90th day, when rates increase again). For outpatient and doctors? services, the initial deductible is $140 and co-payments (your share of the bill) typically equal 20 percent of the amount billed.

Needless to say, all this adds up, quickly. But many people don?t know about these gaps in coverage. ?Older adults and those looking to plan their retirement need to be aware of the extent of out-of-pocket spending under Medicare and do their best to plan accordingly,? said Dr. Amy Kelley, lead author of the new study and assistant professor of geriatrics and palliative medicine at Mount Sinai.

Especially at risk are surviving spouses who may not have adequate resources for their own care or household expenses after a protracted illness depletes the family budget, she said.

Even those who have tried to plan ahead can be affected. That was true for Joanne Stern of Manhattan, who died last November at age 87 after living with osteoporosis for more than 30 years.

During the last four years of her life, as her condition worsened and her frailty increased, Ms. Stern needed 24/7 care, said her daughter Peggy Stern, of New York City. But a long-term care policy purchased by the older woman covered only $200 worth of assistance a day, hardly enough to pay for half a day?s care in a city where home care agencies charge $15 to $20 an hour.

Because Medicare doesn?t pay for the type of assistance Ms. Stern required, the family convinced her to sell her Upper East Side apartment, move into a smaller apartment and use the proceeds to cover the workers who stayed with her day and night.

?I cannot tell you how many of her friends called me up and said, ?How can you move her?? ? Peggy Stern recalled. ?But really, it was the only option she had.?

?My mother talked about leaving her money to her children and her grandchildren and had some regrets about what she was spending,? Peggy Stern continued. ?We had to remind her that we didn?t want that. We wanted to make sure she had what she needed ? a good quality of life.?

Of course, this has become a presidential campaign issue, as the Republicans have proposed a voucher system for Medicare that many analysts predict will end up increasing older adults? out-of-pocket costs. As Robert Moffit, senior fellow at the Heritage Foundation, a conservative research group, recently told Roni Caryn Rabin of The New York Times, all proposals being discussed by the Republicans ?will require seniors to pay more.?

But seniors may well pay more even if traditional Medicare remains intact. The evidence comes from a June 2011 report from the Kaiser Family Foundation that found that people with Medicare spent 16 percent of their income on out-of-pocket medical expenses in 2006 (an average $4,241 per Medicare member), up from 12 percent in 1997.

?If previous trends continue, median out-of-pocket spending is projected to be 19 percent of income in 2011; by 2020, median out-of-pocket spending is projected to reach 26 percent of all income,? the report predicted.

What is your family?s experience with this issue ? and how did you manage unexpected out-of-pocket expenses?
